Congressional Task Force Takes Aim at Nonprofits

What happened:  On May 13, House Oversight Committee Chairman James Comer (R-KY) announced the creation of the Task Force on Defending Constitutional Rights and Exposing Institutional Abuses, appointing Rep. Brandon Gill (R-TX) as chair. Authorized for six months and empowered to hold hearings, the task force has an explicit mandate to investigate what Comer described as institutional abuses in “government institutions as well as politically connected nonprofits and many universities.” Its stated areas of focus include DEI policies, immigration and social welfare program abuse, and foreign-backed efforts to suppress political speech. The task force opened its first investigation within days, sending a letter to the Ohio Department of Medicaid regarding alleged fraud in that state’s Medicaid home health waiver program.

Why it matters:  This is the first dedicated House oversight body to name nonprofits as an explicit investigative target under this administration. Combined with the IRS Whistleblower Alert and the Treasury Form 990 Transparency Initiative issued in April, it reflects a coordinated pattern of heightened federal scrutiny of the sector heading into the 2026 midterms. The National Council of Nonprofits anticipates that unfounded allegations of nonprofit fraud will intensify through election season. What nonprofits should do:  Ensure your financial controls, grant compliance practices, expense documentation, and internal reporting are current. Boards should be actively engaged in financial oversight — not just at audit time. Organizations receiving federal funds should be especially attentive to draw down documentation and subrecipient monitoring.
