Federal Ruling Strips Community Integration From Disability Regulations

What happened:
A federal judge ordered the removal of references to community integration from regulations implementing Section 504 of the Rehabilitation Act of 1973, which bars entities receiving federal funds from discriminating based on disability. The nationwide decision relies on a June 2026 Department of Justice memo reinterpreting the Supreme Court’s Olmstead v. L.C. decision and arguing federal law does not require states to provide community-based services for people with disabilities. A bipartisan House resolution was introduced immediately afterward to reaffirm Olmstead and the right to community-based services.

Why it matters for Pennsylvania nonprofits:
Advocates warn the ruling will make it harder for people with disabilities to access community-based care. Pennsylvania nonprofits providing home and community-based services, supported living, and other community services for people with intellectual disabilities, autism, and physical disabilities should watch how federal agencies and the Commonwealth respond.

Where things stand:
PANO will monitor follow-up litigation and any implications for Pennsylvania’s community-based service system
