House Oversight Task Force Targets Nonprofits

What happened:  House Oversight Committee Chairman James Comer (R-KY) announced on May 13 that Rep. Brandon Gill (R-TX) will chair a newly created Task Force on Defending Constitutional Rights and Exposing Institutional Abuses. The task force is authorized to operate for six months and will hold hearings. On social media and in press interviews, Rep. Gill has explicitly stated that nonprofits are a primary focus of the task force’s investigative work. 

What the task force is targeting:  According to the official mandate, the task force will examine three areas: 

• Institutions perpetuating “illegal race-based or national origin discrimination,” including organizations with embedded DEI policies. 

• Abuse of immigration and social welfare programs — described as perpetuating chaos, suppressing wages, defrauding taxpayers, and extending “de-facto amnesty.” 

• Efforts to suppress Americans’ speech, particularly political speech, allegedly at the behest of foreign actors and “dark money” groups. 

What Rep. Gill has said about nonprofits:  In public statements, Rep. Gill has said that organizations “taking tax dollars” that engage in what he characterizes as illegal activity, domestic unrest, or political activity are legitimate targets for investigation. He has stated the task force will examine whether taxpayer money is going to “NGOs or other entities that are working against you and against American interests.” The task force launched its first investigation by requesting documents related to alleged Medicaid fraud in Ohio’s Home and Community-Based Services program. 

The Democratic response:  Ranking Member Robert Garcia (D-CA) has appointed Rep. Lateefah Simon (D-CA) as the lead Democrat on the task force. Democrats have characterized the task force as an instrument for attacking civil rights organizations and programs millions of Americans rely on. Rep. Val Scanlon (D-PA), Ranking Member of the Subcommittee on Constitution and Limited Government, has separately launched an inquiry into DOJ whistleblower allegations regarding the task force’s activities.

On May 13, House Oversight Committee Chairman James Comer (R-KY) announced the creation of the Task Force on Defending Constitutional Rights and Exposing Institutional Abuses, naming Rep. Brandon Gill (R-TX) as chair. Authorized for six months, the task force was given an explicit mandate to investigate “institutional abuses” at nonprofits and universities, with a stated focus on DEI policies, immigration and social-welfare program compliance, and foreign-backed efforts to suppress political speech. It opened its first investigation within days, sending a letter to Ohio’s Medicaid department regarding alleged fraud in that state’s home health waiver program. The National Council of Nonprofits warned that unfounded fraud allegations against the sector would likely intensify heading into the 2026 midterms, and PANO urged members to keep financial controls, grant compliance, and board oversight documentation current.
